Valid passport with 6+ months validity
Passport must be valid for at least 6 months beyond intended date of entry to the United States.
Bachelor's degree or higher
Degree must be equivalent to at least a U.S. bachelor’s degree in a field related to the specialty occupation; foreign degrees must be evaluated for equivalency by accredited assessment agencies.
Job offer from U.S. employer
Evidence of a specific, bona-fide job offer for a specialty occupation that requires a bachelor’s degree or higher. Offer documentation must be provided by the U.S. employer.
Labor Condition Attestation (LCA) approved by Department of Labor
U.S. employer must obtain a certified LCA from the Department of Labor attesting to pay, working conditions, and notification of employment terms. Must be included in H-1B petition.
H-1B petition (Form I-129)
Form I-129, Petition for a Nonimmigrant Worker, completed and signed by the U.S. employer, with required supporting documents.
Payment of $100,000 H-1B application fee
A payment of $100,000 must accompany or supplement the H-1B petition for adjudication. Unless specifically exempted by regulations.
Foreign degree evaluation
If the applicant holds a foreign degree, an official credential evaluation stating U.S. equivalency must be provided by an accredited agency.
Resume/CV
Up-to-date curriculum vitae detailing education, work history, and qualifications relevant to the specialty occupation.
Employment verification letters
Official letters from previous employers verifying relevant work experience in the field (if required by position or degree equivalency).
Proof of equivalent work experience (if no bachelor's degree)
If applicant does not have a bachelor’s degree, proof of at least 12 years relevant progressive work experience in the specialty field is required (3 years of experience for each year of missing university study). Must be assessed and equivalency confirmed.
English language proficiency (recommended, not mandatory)
Proof of English proficiency (IELTS, TOEFL, etc.) is not formally required for H-1B but may be requested by employers or consular officers.
Medical examination by approved physician (after approval, if requested)
Medical examination is not required for H-1B visa issuance but may be requested for change of status (adjustment of status) or in specific cases.
Police clearance certificate (if requested)
A police clearance certificate may be requested at the discretion of the consular officer or for certain nationalities.
